Disgraced police officer Abba Kyari demands N500 million in damages from NDLEA. He also wants an order “restraining the agency, it’s officers, servants, police, privies, or anyone acting on their behalf from further harassing, detaining, intimidating, or arresting him unlawfully.

The National Drug Law Enforcement Agency, NDLEA, has been sued by Abba Kyari, the suspended Deputy Commissioner of Police (DCP), for N500 million in damages for alleged unlawful arrest and detention.

Kyari also wants an order instructing the NDLEA to tender a written apology to him in two national dailies, according to an originating motion on notice filed before Justice Inyang Ekwo of a Federal High Court in Abuja.

His lawyer, C. O. Ikena, also wants an order “restraining the respondent (NDLEA), its agents, servants, police, privies, or anyone acting on their behalf from further harassing, detaining, intimidating, or arresting the applicant unlawfully,” according to the motion, which was dated February 16 and filed February 17.

“An order of this court directing the respondent to pay the applicant the sum of N500,000,000.00 (five hundred million nairas) for the unlawful breach of the applicant’s constitutional right provided for in Sections 35 and 36 of the Federal Republic of Nigeria (As Amended) by the respondent.”

Kyari also wants a declaration that his arrest and imprisonment by the NDLEA “without putting him before a court of competent authority from February 12 to date is unlawful, illegal, and a serious breach of his fundamental rights,” according to his request to enforce his fundamental rights.

The National Drug Law Enforcement Agency (NDLEA) arrested Kyari and others on Monday for alleged ties to an international narcotics syndicate.

The Police Service Commission (PSC) suspended the policemen charged with links to an international narcotics syndicate on Thursday.

“DCP Abba Kyari, who was under suspension before to this allegation, shall stay on suspension,” the PSC wrote.

The anti-narcotics agency had previously reported Kyari’s words to undercover operatives investigating the cocaine bust.
